A mediator relies upon securing the trust of all parties - principals, supporters, and advisors - in order to perform effectively in his or her role.
This trust enables the mediator to receive confidences from all the parties, and thus to see a possible settlement zone that is not visible to any of the parties on their own.
It is therefore essential, when approaching a potential mediator, first to propose him or her as a candidate to the other party or parties to the dispute to be mediated. Otherwise, the mediator may be perceived (rightly or wrongly) as "your man (or woman)", and either be vetoed at the outset (most likely), or be more susceptible to distrust during the mediation by your opponents. A mediator does not give legal advice before or during a mediation, and does not give a decision at the end of the mediation if the parties have not reached a settlement: it is therefore vital that no comment that could be construed as advice is sought from the candidate mediator when initial contact is made.
